End User License Agreement (EULA)

1. Introduction
This End User License Agreement ("Agreement") is a legal contract between you (the "User") and KiwiFlightSim ("Licensor") regarding the use of the NSAS & NSFQ - Manu'a Islands, American Samoa ("Software") for "Microsoft Flight Simulator 2020 and Microsoft Flight Simulator 2024". By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.

2. License Grant
The Licensor grants the User a non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the products(s) solely for personal, non-commercial purposes. The User agrees not to copy, resell, sublicense, rent, share, or distribute the products(s) in any form. This license is subject to the terms and conditions outlined in this Agreement.

3. Ownership and Intellectual Property
The Software is the intellectual property of the Licensor and is protected by copyright and other intellectual property laws. The products(s), whether modified or not, and all intellectual property and copyright contained therein, shall remain the sole and exclusive property of the Licensor. The User acknowledges that no ownership rights are being transferred under this Agreement and agrees that, under no circumstances, shall the User claim or attempt to claim ownership of any intellectual property rights or copyright in the Software, regardless of whether it has been modified.

4. Restrictions on Use
The User agrees not to:

Reverse engineer, decompile, or disassemble the products(s).
Modify, adapt, or create derivative works based on the products(s).
Rent, lease, distribute, or sublicense the products(s).
Share, upload, or distribute the products(s) on any website, marketplace, or file-sharing service without express permission from the Licensor.
Use the Software for any commercial purpose without prior written consent from the Licensor.

5. Limited Warranty
The products(s) is provided "as is," without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. The Licensor does not warrant that the products(s) will be free from errors or that it will meet the User’s specific requirements.

6. Limitation of Liability
In no event shall the Licensor be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the Software, even if the Licensor has been advised of the possibility of such damages.

7. Entire Agreement
This Agreement constitutes the entire understanding between the User and the Licensor regarding the use of the products(s) and supersedes all prior agreements and understandings, whether oral or written.

By installing or using the NSAS & NSFQ - Manu'a Islands, American Samoa for MSFS 2020 and MSFS2024, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms.
